Terms & Conditions
Last updated: July 2026. These Terms apply to all bookings of diving activities, courses, boat trips and other services offered by Open Water Croatia (“we”, “us”). By booking or participating in an activity you accept these Terms. The English version is the binding version.
1. Who we are

2. Booking and payment
A booking is confirmed once we have received the applicable deposit or full payment and you have received our written confirmation. The person making the booking must be at least 18 years old, provides accurate information for all named participants and confirms that all participants have been informed of these Terms.
- Payment online via our booking system (major credit and debit cards accepted) or in person. Online charges may appear on your statement under the name of our authorized booking/payment provider.
- Deposit options as offered at checkout (e.g. 20% or 50% at booking); the balance is due no later than the start of the activity.
- All prices are per person, in euros (EUR) and include Croatian VAT (PDV) unless stated otherwise. Prices do not include gratuities, personal insurance and items not listed under “Included”.
- If payment is not made on time, we may refuse the activity or withdraw from the contract.
3. Cancellation by you
- Group activities and dives: free cancellation and full refund with at least 48 hours notice. Within 24 hours you may instead rebook to another date, subject to availability.
- Private and custom activities: free cancellation and full refund with at least 5 days notice.
- Late arrival / no-show: if you miss the departure, the full price is charged, as places and staff have been reserved for you.
Right of withdrawal: under Article 79 of the Croatian Consumer Protection Act (implementing Art. 16(l) of Directive 2011/83/EU), the statutory 14-day right of withdrawal for distance contracts does not apply to leisure services agreed for a specific date. The cancellation conditions above apply instead.
4. Cancellation and changes by us
- Safety comes first. If we consider that weather or sea conditions compromise safety or quality, we may delay, reschedule or cancel an activity.
- If we cancel before the start, you choose between a full refund or rebooking.
- If an ongoing activity must be aborted for safety reasons, we will offer an alternative of comparable value where reasonably possible.
- We may adjust itineraries, dive sites and pick-up logistics where necessary; confirmed prices do not change after booking.
- Agreed refunds are processed within 14 days to the original payment method.
5. Diving – health and safety requirements
- Minimum age: 10 years for introductory dives (Try Scuba), 12 years for the Open Water Diver course; minors require the consent of a parent or legal guardian.
- Every diver must truthfully complete the standard medical statement before the first dive. Certain answers require physician approval – contact us in advance.
- You must be able to swim and float unassisted and must not be under the influence of alcohol or drugs. No alcohol before diving.
- Certified divers must present a valid certification card (and logbook on request) and dive within the limits of their certification level.
- The instructor or guide has final authority on dive planning, depths, sites and may exclude participants from an activity for safety reasons; in that case no refund is owed if the exclusion results from your breach of these requirements.
- No-fly time: do not fly or travel to high altitude within 18 hours after a single dive and 24 hours after repetitive dives. Plan your schedule accordingly – we are not liable for travel plans that conflict with this rule.
- Training courses follow SSI standards; certification requires completion of all course requirements.
6. Your responsibilities
- Arrive on time at the agreed meeting point (usually Ravnice 2, Omis). Departure times cannot be delayed for late arrivals.
- Follow the instructions of guides, instructors and skippers at all times and treat staff and other guests with respect. We may remove disruptive participants from an activity without refund.
- You are liable for damage to or loss of equipment entrusted to you, caused by negligent handling contrary to instructions.
- Valid travel documents, visas and personal travel insurance are your responsibility.
7. Insurance
Diving activities include the insurance stated in the respective offer. No comprehensive travel insurance is included. We strongly recommend travel insurance covering cancellation, medical expenses and – for certified divers – dive-specific coverage (e.g. DAN).
8. Liability
We operate with certified staff and maintained equipment according to applicable Croatian regulations and training standards. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for intent or gross negligence. In all other respects, our liability is limited to the extent permitted by Croatian law; we are in particular not liable for delays, changes or losses caused by weather, sea conditions, force majeure, official orders or other circumstances beyond our reasonable control, nor for loss of or damage to personal belongings.
9. Photos and videos
Our team takes photos and videos during activities. Those showing you individually are shared with you as part of the service. We may use group and activity material for our website and social media on the basis of legitimate interest; if you do not wish to appear, simply tell your guide before the activity – we will respect it. 10. Complaints
If something is not right, tell your guide, instructor or skipper immediately so we can resolve it on the spot. In accordance with Article 10 of the Croatian Consumer Protection Act, you may submit a written complaint to Open Water Croatia, Ravnice 2, 21310 Omis, Croatia or info@openwater.hr. We will confirm receipt without delay and respond in writing within 15 days. To help us investigate, we ask that complaints be submitted within 30 days of the activity; your statutory rights remain unaffected.
11. Children
Children are welcome on selected activities when accompanied by an adult. On selected boat trips, children aged 4 and older pay 50% of the adult price; children under 4 travel free on an adult’s lap. Age minimums for diving (Section 5) always apply.
12. Good to know
- No smoking in our vehicles or on our boats.
- Please limit food on board to snacks; beverages only in covered containers.
- Our staff speaks English; guiding in German, French and other languages is available on request.
13. Final provisions
These Terms constitute the entire agreement between you and Otvorena Voda d.o.o. and may only be varied in writing. Should individual provisions be invalid, the remainder stays in effect. This contract is governed by the law of the Republic of Croatia. For consumers, mandatory consumer-protection provisions of their country of residence remain unaffected. Place of jurisdiction is the competent court in Split, Croatia; consumers may also bring proceedings at their statutory place of jurisdiction. Obvious printing and typographical errors are not binding.
